TRADE MARK APPLICATION INFORMATION

Feb 17, 2026

At LL Shadrach Attorneys, we understand the value of protecting your intellectual property, and we are here to assist you in securing your brand’s identity within South Africa.

WHY CHOOSE US?

We pride ourselves on providing a hassle-free, transparent, and cost-effective trade mark registration process. We believe in delivering exceptional value to our clients, which is why we offer:

Comprehensive, All-Inclusive Fees:

We charge a one-time, all-inclusive fee for trade mark registration. No hourly rates, no hidden costs — just a straightforward pricing structure designed to simplify the process for you.

Expertise in 45 Classes:

Trade marks can be classified into 45 classes of goods and services. We will carefully assess your business needs and file your trade mark in the class or classes that are most relevant to your industry.

Our search may reveal that your brand may have to be registered in more than one class for comprehensive protection and we will advise you of these classes.

Initial Availability Search:

Before we proceed with your trade mark application, we conduct a thorough availability search. This search identifies any existing trade marks that could pose obstacles to your registration, ensuring a smoother process for you.

Prompt Response and Proof of Filing:

Once we submit your trade mark application, you will receive proof of filing within 24–48 hours. We prioritize efficiency to get your protection process started promptly.

Patience and Expertise:

Trade mark registration in South Africa typically takes 18 to 36 months. Rest assured that this waiting period is standard for everyone, even major brands like Coca-Cola and KFC. We will keep you informed where necessary and navigate any official actions on your behalf.

After Service:

The registration of a trade mark allows the owner the right to monopolize the mark within South Africa, for a period of 10 years, renewable every 10 years. Our offices will assist with the renewal at a reduced fee.

TRADE MARK FILING FEES

Our fee for each class filed is R3 500 – payable in advance of our application submission.

This one-time fee covers a comprehensive range of services, ensuring a smooth trade mark registration process for you:

  • In-depth consultation and an initial availability search.
  • Expertly handling the application filing process.
  • Swift response to any official actions, including clear communication with you about any necessary conditions for mark acceptance.
  • Efficient arrangement of mark advertisement in the Patent Journal.
  • Successful acquisition of your registration certificate.

With our all-inclusive fee, you can confidently pursue trade mark registration, knowing that all necessary steps are covered.

PLEASE NOTE that the timeline for trade mark registration (typically 18 to 36 months) is only a guideline, and we cannot guarantee exact timing. Our fee structure does not include regular updates during this process. We will contact you only if further information is required or when your trade mark is registered. However, you are welcome to request a status update at any time, and we will gladly provide feedback.

INTERNATIONAL EXPANSION ASSISTANCE

Should you require trade mark protection beyond South Africa’s borders, we are well-equipped to assist you. Our team will work closely with you to provide a tailored solution and a competitive quotation for international trade mark registrations. Fees for international registrations may vary by country.
